And technically roms dont enable call recording in google dialer, they do it in aosp dialer. G-dialer never had call recording in the first place until recently

they updated app some oems like nokia got it in legal countries also now google dialer don't need overlay now its available for most of devices now like every other google app

The preference for shipping a rom with gapps is to get rid of building issues, and especially with a/b devives.
